Where can an MSME claim be filed?If you are a Micro, Small, or Medium Enterprise (MSME) located in a state or union territory, it's essential to know that the MSEFC's territorial jurisdiction is limited to that particular area. For instance, if an MSME located in Delhi has a disagreement with a buyer from another state over delayed payment, the MSME can file a claim with the MSEFC in Delhi. It's important to emphasize that the MSEFC resolves disputes specifically related to delayed payments to MSMEs, as outlined in the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006. However, for other kinds of disagreements or claims, MSMEs may have to approach other forums or authorities, depending on the claim's nature and relevant laws and regulations. Therefore, it's crucial to file disputes where the supplier of the goods or services is located. Additionally, conciliation or arbitration should occur in the same location as the supplier of the goods or services.

What is MSME Facilitation Council?Section 20 of the Act outlines the State Government's responsibility to create Micro and Small Enterprise Facilitation Councils (MSEFC). Each council is expected to have three to five members, and their composition and procedures are to be established by the State Government. Section 18 of the Act outlines the general function of the Micro and Small Enterprise Facilitation Council. The council is responsible for conducting conciliation first. If conciliation fails without any resolution between the parties, the council will take up the dispute for arbitration or refer it to any institution or center providing alternate dispute resolution services for arbitration. For conciliation, the provisions of sections 65-81 of the Arbitration and Conciliation Act, 1996 apply, as if the conciliation was initiated under Part III of that Act. If arbitration is necessary, the provisions of the Arbitration and Conciliation Act, 1996 (26 of 1996) apply to the dispute, as if the arbitration were in pursuance of an arbitration agreement referred to in sub-section (1) of section 7 of that Act.

How does MSME Facilitation Council Work?Section 21(2) outlines the process for members of the Facilitation Council to discharge their duties, which can be prescribed by the State Government. However, there is a general procedure that is typically followed: The claimant files an MSME claim. The other party is notified and given 15 days to conciliate and pay. If payment is not made within 15 days, the MSME council proceeds with admitting the claim and referring the matter to arbitration by either appointing an arbitrator or arbitrating themselves. An arbitration proceeding takes place, culminating in an award. If the award is not paid, it can be executed under the provisions of Section 36 of the Arbitration and Conciliation Act, 1996.
